Terms of Service

These Terms of Service ("Terms") govern your access to and use of LingoHero, including our website, apps, and any services we provide (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Overview

LingoHero is an AI-powered speaking coach for exams such as TOEFL (2026), IELTS, PTE, and TOEFL Junior. Features include adaptive and focused drills, instant AI scoring and feedback, and optional shareable links for third parties to view your responses.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the Service. You are responsible for safeguarding your account credentials and all activity under your account. Provide accurate information and keep it up to date.

3. License & Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial learning. You agree not to: (a) reverse engineer, decompile, or attempt to derive source code; (b) interfere with or disrupt the Service; (c) use the Service to violate any law; (d) upload malicious code; or (e) use automated means to scrape or harvest data except as permitted by us in writing.

4. User Content & License

You may submit content, including audio recordings, text responses, images, and feedback ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant LingoHero a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and create derivative works of your User Content solely as needed to operate, improve, secure, and provide the Service (including training models that personalize your experience), and to comply with law.

5. Shareable Links

The Service may let you generate private, unlisted links to specific responses or results so that coaches or peers can view them. Anyone with the link may access the shared item. Treat these links like public to those you share them with. You are responsible for where you share links. You can stop sharing by deleting the shared item or disabling sharing where available. We are not responsible for what recipients do with shared content.

6. Focused/Personalized Drills & AI

The Service uses automated processing to provide personalized drills and feedback. Scores and suggestions are estimates and are not guaranteed to match any official test. LingoHero is not affiliated with or endorsed by ETS, IELTS, PTE, or any testing authority.

7. Beta Features

Some features may be offered as beta or preview. They are provided "as is" and may change, break, or be discontinued at any time.

8. Third‑Party Services

The Service may integrate third‑party services (e.g., cloud storage, analytics, payment providers). Your use of those services may be subject to their own terms and policies. We are not responsible for third‑party services.

9. Subscriptions & Payments

Plans & Billing: LingoHero offers subscription plans (monthly or annual) with auto-renewal. The subscription price, billing cycle, and features are displayed at the time of purchase through your app store (Apple App Store or Google Play Store).

Auto-Renewal: Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. You will be charged through your app store account.

Cancellation: You may cancel your subscription at any time through your app store account settings (iOS: Settings → Apple ID → Subscriptions; Android: Play Store → Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the subscription expires.

Refunds: Payments are generally non-refundable except as required by applicable law or app store policies. Contact your app store for refund requests. In cases of technical errors preventing service delivery, we may issue credits or refunds at our discretion.

Price Changes: We may change subscription pricing with reasonable advance notice. Price changes will not affect your current billing cycle but will apply upon renewal.

Free Trials: New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, you will be charged for the subscription. Trial eligibility is limited to new users and determined by your app store account.

10. Intellectual Property

LingoHero and its licensors own all rights in the Service and its content, excluding User Content. You may not use our trademarks, logos, or branding without our permission. Educational references to exams are nominative and do not imply endorsement.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. SCORES AND FEEDBACK ARE ESTIMATES FOR LEARNING PURPOSES AND DO NOT GUARANTEE ANY EXAM RESULT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINGOHERO AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD $50, WHICHEVER IS GREATER.

13. Indemnification

You agree to defend, indemnify, and hold harmless LingoHero and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time and may delete your account and data via in‑app settings where available. Upon account deletion, we will delete or anonymize your personal data within 30 days, subject to legal retention requirements. Some provisions survive termination, including those concerning ownership, disclaimers, limitations of liability, and dispute resolution.

15. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. Any dispute will be resolved through binding individual arbitration administered by a recognized arbitration provider, and you waive any right to participate in a class action or class‑wide arbitration. Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or unauthorized access to the Service.

16. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
